He sued Chad Slater, not the magazine. Chad Slater didn't publish anything. Nevertheless, Cruise sued Slater in order to intimidate him, because he knew Slater couldn't defend himself. He didn't sue the publisher, who could. It's like the bully at the school yard who picks on the smallest kid.

How is Slater supposed to prove he had sex with Cruise? Are escorts supposed to be taking pictures of their encounters?

And, yes, anybody with money can intimidate and extort those without money in our courts. It's like the kids' playground, except in our courts it's money, not muscle that count. "My lawyer is bigger than your lawyer."

What exactly did the magazine publish? If it says "XYZ escort states he had sexual relations with Tom Cruise," then it means just that: XYZ said such and such. People can chose to believe XYZ or not. I can say I came from the planet Claire, and if people want to believe I came from there, it's their prerogative. The tabloid is just reporting its sources, and people have to use their judgment as to whether to believe it. Most people aren't going to take an escort's statement to a tabloid as the gospel truth. In fact, I can't imagine that more than a tiny number of people would give it much credibility. What's the damage if nobody believes the statement anyways. Besides, no one would ever have known about this if it weren't for the suit. The statement never came to anyone's attention. But Cruise's lawsuit did make it in Newsweek last week...

Sorry, but I was using "publish" in the sense in which it is used in defamation cases. In that context, you "publish" a statement when you communicate it to another person by any means.

First, I've already pointed out that the complaint gives Cruise the option to add other defendants to the suit. Second, if the defamatory statements that the mag reported came from Slater in the first place, he is certainly the logical person to sue.

If the statements he made are true, he should certainly remember details of their encounters that only someone with intimate knowledge of Cruise could know. Remember the Lewinsky case?

Making false and defamatory statements about another person is a violation of our laws. That is not a secret. People who don't want to be or can't afford to be sued simply shouldn't do it. If they choose to do it, they shouldn't complain about the consequences.

 

If Slater gave the interview, what was his motive for doing so? Charity? He wanted to publicize himself by making sensationsal statements about someone in whom the mag's readers would be interested. He was using Cruise's fame for his own benefit. Is that what you're defending?

If it can be shown that the story reached few people, that may affect the damages the court awards to Cruise. But Cruise can't be held responsible for the fact that other media outlets make news of the suit. He has a right to ask for the protection of the courts when someone defames him.

Tom Cruise: Really Not Gay

When Tom Cruise says he's not gay, he means it.

Just a month after suing a gay porn star, Cruise has filed yet another $100 million lawsuit--this time against a man who allegedly claimed he had a videotape supposedly proving Cruise is homosexual.

 

The lawsuit, filed Monday in Los Angeles Superior Court, alleges that a man who goes by the name Michael Davis sent emails offering a videotape of Cruise supposedly having sexual relations an unnamed man. The 38-year-old actor says the claims are "unequivocally false" and no such tape exists.

 

Cruise's lawyer, Bert Fields, did not immediately return calls for comment on the lawsuit. But it marks yet another attempt by Cruise to squash rumors about his sexual orientation. On May 2, he filed a $100 million lawsuit against Chad Slater (aka Kyle Bradford), a gay porn star and self-described "erotic wrestler," who allegedly told French magazine Actustar that he had a fling with Cruise that led to the breakup of his marriage to Nicole Kidman.

 

Bradford later denied ever speaking with the publication, or ever meeting Cruise. Actustar denied the report was anything more than a rumor and reportedly agreed to publish a retraction.

 

"[Cruise] is a great respecter of homosexual rights, but he's not gay, and he's ready to prove this in court," Fields said at the time. "Tom is tired of it and it hurts his children. It's something that will be there forever. And damn it, he's going to stop it."

 

Bradford, meanwhile, has posted a statement on his Website announcing that, "having been thrust into the international spotlight," he is leaving the porn and wrestling-video industry. The skin-flick thespian--who plans to write a book on his life in gay porn--is also selling his domain names, as well as exclusive rights to his wrestling videos, on eBay. Bidding has already reached $5,000 for such sites as Kylebradford.com, usedjockstrap.com and kylelivecam.com.

 

Bradford signed off his online letter to fans saying, "Wrestle hard guys." (But we're not quite sure whether he actually meant "Wrestle hard, guys.")
